Common grounds to appeal a code 26 PCN
- An exemption in section 85 of the Traffic Management Act 2004 applied: emergency services; loading/unloading to premises that could not reasonably be done otherwise, for no longer than necessary and no more than 20 minutes; building, waste-collection, road or utility works.
- You had stopped for circumstances beyond your control, to avoid an accident, or briefly to let people get in or out (stopping for those reasons is not 'parking').
- Part of the vehicle was within 50 cm of the kerb.
Also check the PCN itself: are the date, time, location, vehicle and code correct, and was it served on time? Errors can support the statutory grounds, such as procedural impropriety or 'the contravention did not occur'.
Evidence to gather
- Clear, dated photos of the vehicle position, road markings and every nearby sign or time plate (take them as soon as possible).
- Delivery or works paperwork with times.
